2.6 PATERNITY LEAVE

Paternity Leave will run concurrently with FMLA, if applicable. You will qualify for paternity leave if you:
Have or expect to have responsibility for your baby’s upbringing.
Are the biological father of the baby and/or the mother’s husband or partner (including same-sex partners).
Have been continuously employed by us for 26 weeks by the start of the 14th week before the Expected week of childbirth (EWC).
Are taking the leave to support the mother or care for the baby.
One parent of a couple who adopt a child is also entitled to paternity leave. Paternity leave must be taken at the time of, or soon after, birth and in any event is forfeited if not taken within two months of birth.

(I) NOTIFICATION

Paternity leave must be taken with the prior agreement of your Department Head and notified to P&C by your partner’s “Qualifying Week” (the 15th week before the expected week of childbirth (EWC). You must give notice stating when the EWC or scheduled adoption date is, how much paternity leave you wish to take and when you wish paternity leave to commence (either a specified date or on the birth of the child). However, paternity leave cannot start prior to the birth of the child and it must end within 56 days of the birth. If you subsequently wish to change the date on which your paternity leave commences, you should agree this with your Department Head and notify P&C.

As long as you have provided correct notification, your paternity leave will start on the date you intended unless:

You intended it to start on the date of the birth or scheduled adoption date and you are in fact at work on that date (in which case it will begin the next day); or
You specified a date when you intended it to start but the baby was born prematurely or not born by then or adoption did not happen by then (in which case you must change the date or choose to take leave from the actual date of birth or adoption or a specified number of days afterwards and you must give the Company notice as soon as possible).

Once the baby is born or adoption has taken place, you must notify us in writing that the baby has been born or adoption has taken place.

(II) PAY

Provided that you comply with the notification requirement above and you have 26 weeks’ service by the 15th week before the expected week of childbirth, you will be entitled to two weeks of paternity leave; one week of full pay followed by a week of unpaid leave (or FMLA, if applicable).

Provided that you comply with the notification requirement above and you have 26 weeks’ service by the 15th week before the expected week of childbirth,  you will be entitled to two weeks of paternity leave; one week of full pay followed by a week of Statutory Paternity Pay (SPP). You must fill out a form and return to us 28 days prior to start of the SSP. The form can be found here. 

As long as you have had average weekly earnings of not less than the lower earnings limit for National Insurance Contributions for a period of 8 weeks, ending with the 15th week before the EWC, you will qualify for SPP during your paternity leave.

SPP is payable at a flat rate which is set by the Government or 90% of your average weekly earnings if less. You will receive your other non-cash contractual benefits as usual during paternity leave.
